MB Pro Stuck on version 3.7

With the issue with version 3.8 over the weekend that was preventing the unit from running, I downgraded to version 3.7. After rebooting again with "get newest on boot" selected I am not getting version 3.9. Is there something else that needs to be done to get latest version?
